Received a Request for Evidence? What to Know Before Responding

November 4, 2026

A Request for Evidence (RFE) means USCIS is requesting additional documents or information to assess your application or petition. It gives you an opportunity to address specific questions about your case.

Start by reading the full notice and identifying what USCIS requires.

Check the deadline and instructions

Your RFE states the response deadline and identifies the requested evidence. Review the submission instructions and confirm the deadline for your response.

Address each request

Convert the notice into a checklist. Match each requested item to the document or explanation that addresses it, and compare your response with the application you originally submitted.

If USCIS questions information already provided, locate the earlier filing to review it accurately. An attorney can help identify what needs clarification or additional support.

Prepare a complete response

Requested materials must be submitted together. USCIS treats a partial response as a request for a decision on the record.

Before submitting, ensure your response addresses each issue and includes the requested documents. If anything is unavailable, seek prompt legal advice on how to explain it and whether alternative evidence may be appropriate.

Keep a complete copy of the RFE, everything you submit, and proof of delivery or online submission.

Get guidance before you respond

An attorney can help you understand the request, review for evidence gaps, and ensure your response is consistent with your case history.

For an initial review, bring the complete RFE, your filing receipt, a copy of your original application if available, and any documents you have collected. When contacting Ballout Law, mention the response deadline.
