Under the Trump administration, U.S. Immigration and Customs Enforcement (ICE) focuses on immigrants who pose a threat to public safety or national security. The plan emphasizes the removal of undocumented individuals who have a criminal history or who have been ordered removed by a judge but remain in the country.

Over 1.5 million people in the U.S. have been ordered to leave but have not yet done so. These individuals are now a major focus of immigration enforcement.


Workplace Raids May Return
Large worksite raids, which had stopped in recent years, could begin again targeting undocumented workers.
ICE plans targeted enforcement, focusing on individuals on their priority list. While there won’t be widespread neighborhood raids, limited detention space (41,000 beds) could slow down their plan. Expect more funding for additional beds from Congress soon.

protect yourself
Resolve Criminal Convictions
If you were convicted of a serious crime, talk to a skilled criminal lawyer about vacating your conviction due to constitutional violations. Expungement does not work for immigration purposes!
File a Motion to Reopen (MTR)
If an immigration judge has already ordered your removal (Final Order of Removal), act immediately. Consider reopening your case, which would allow you to fight your removal.
A judge may allow reopening if your previous lawyer made mistakes, failed to prepare you, failed to file legal briefs, or missed deadlines or appeals.

Consider Other Immigration Relief
Asylum Applications
Changes to asylum laws and processing, some of which may be mitigated by acting now, are expected. Discuss your fears of returning to your country with an attorney. You may file for asylum now despite the one-year filing deadline from arrival.
U or T visas (Victim of a qualifying crime or Trafficking)
If you have been a victim of a crime in the USA or were trafficked, take action now by contacting a competent immigration lawyer.
Adjustment of Status (Green Card Application)
Eligibility may depend on many factors, including being paroled, waived in by car at the US border or under 245(i)

If approached by Immigration and Customs Enforcement (ICE), you don’t have to provide any information about your nationality or immigration status. The government has the burden of proving that you are not authorized to remain in the USA.
Prepare Now
You should promptly renew your DACA, TPS, green card, or work authorization. If you are eligible, you should apply for naturalization.
Don’t Delay
