Challenge

Our client had been in deportation proceedings since 2007. For over a decade, the case dragged on, and with prior representation, they felt unsupported and without clear direction. By the time they came to Ballout Law in 2021, the government alleged that they had entered the U.S. unlawfully, and deportation threatened to separate them from their U.S. citizen spouse.

Our Strategy

First, we proved that the client had entered the United States lawfully, successfully countering the Department of Homeland Security’s allegations. Second, we presented a strong case of extreme hardship to the U.S. citizen spouse, supported by psychological evaluations, expert testimony, and extensive documentation of the emotional, financial, and medical impact that deportation would cause.

Result

The Immigration Judge granted both a hardship waiver (I-601) and adjustment of status (I-485). After more than 15 years in removal proceedings, the client was finally able to secure lawful permanent residency and the right to remain with their family in the United States.
