A Texas federal court has paused parole approvals under the new Parole in Place program for 14 days, but applicants can still submit applications to USCIS during this time.
August 2024 – The Eastern District Court of Texas has issued a 14-day administrative stay on approvals under the new “Keeping Families Together” Parole in Place (PIP) program, following a lawsuit brought by 16 U.S. states. While this stay is in effect, applicants can still submit Form I-131F to U.S. Citizenship and Immigration Services (USCIS), but no approvals will be granted during this period.
The stay may be extended as the court considers the legality of the program, with a decision expected by fall 2024. Regardless of the outcome, appeals are anticipated.
What You Can Do Now
Despite the temporary pause, there are proactive steps you can take:
- Continue Submitting Applications: USCIS is still accepting PIP applications. If you believe you qualify, you can submit Form I-131F during this time.
- Attend Biometrics Appointments: If you have a scheduled biometrics appointment, make sure to attend as planned. This will keep your application moving forward.
- Consult with Immigration Counsel: It’s crucial to discuss your case with a qualified immigration attorney to understand the risks and benefits of applying now, and to prepare for any potential outcomes as the litigation unfolds.
- The courts will decide whether this program will be authorized/upheld. However, Ballout Law, APC, is optimistic, as a similar precedent program exists and is functioning for military personnel.
While the situation is still evolving, staying informed and prepared will put you in the best position to benefit from the PIP program when approvals resume.
