June 18, 2024 – President Biden unveiled new executive actions that will provide deportation protection to approximately half a million undocumented spouses of U.S. citizens.
The plan introduces “parole in place” for undocumented individuals who have resided in the U.S. for at least 10 years. This initiative not only shields eligible immigrants from deportation but also enables them to apply for legal permanent status.
The “Parole in Place” policy provides work permits and deportation protections to undocumented immigrants married to U.S. citizens, allowing them to stay in the country legally without the fear of deportation. This policy also offers a pathway to permanent legal status and eventually U.S. citizenship, making it one of the most significant immigration relief programs in recent history.
Who is Eligible Under Biden’s Parole in Place plan?
Under the forthcoming parole program announced by the Biden administration, detailed eligibility criteria will soon be shared in the Federal Register. Until that full disclosure, the specifics remain somewhat ambiguous. Yet, according to the June 18 briefing, applicants must satisfy several key qualifications to be considered for this parole initiative:
- Continuous residency in the United States since June 17, 2014, is required.
- Applicants must have been physically present in the U.S. on June 17, 2024.
- Qualification is contingent upon being legally married to a U.S. citizen by June 17, 2024.
- Eligibility extends to those who entered the U.S. without formal admission or parole and who currently lack any lawful status.
- Have not been convicted of any disqualifying criminal offense.
- Applicants must not pose any risk to national security or public safety.
- A favorable exercise of discretion must be merited by the applicant’s circumstances.
Estimated Beneficiaries:
- Nearly 500,000 undocumented spouses are expected to qualify for this relief.
- Additionally, 50,000 non-citizen stepchildren with a U.S. citizen parent would also be eligible for this protection.
In addition, minor children of applicants, who are also the stepchildren of the applicant’s U.S. citizen spouse, will be eligible to apply alongside their parents.
At this time, there is no exact guidance on how people can show they weren’t convicted of disqualifying offenses, do not pose threats to security, or merit a favorable exercise of discretion. The Biden administration will likely publish further information when the program rolls out in the next couple of months. It is also unclear at this point whether the administration will charge a fee for applicants, like it did for the DACA program.
Approval Process:
- The Department of Homeland Security will assess each eligible case.
- Approved applicants will be given three years to apply for permanent residency.
