Withholding of Removal

Individuals who are barred from asylum may remain eligible for what is known as “withholding from removal.” Withholding from removal prohibits the U.S. government from deporting someone to a country where their life or freedom may be threatened due to race, religion, nationality, political opinion, or membership in a particular social group. This application is typically presented to an immigration judge during immigration removal proceedings.
